It is a lot more than just handing a set of documents to another person; it’s about making sure the process is served correctly in every case. Any country which is a member of the Hague Convention will have reciprocal arrangements in place for the document to be served. Process Serving

Our process serving service is engaged for an array of documents, from Statutory Demands through to Bankruptcy Petitions, Claim Forms, Divorce Documentation and more.

There are many reasons why you should enlist the services of a process server. These are the documents that we are engaged to serve, and the process that must be followed:

Statutory Demands

This is the first stage of bankruptcy. Anyone can compile a statutory demand to be served as it is not issued by the court. They can be served on both individuals and companies and are in relation to a debt.

Statutory Demands can either be personally served or go through a process known as Substituted Service if the debtor is difficult to contact. This involves confirming the debtor still resides at the address and sending a letter of appointment via post confirming a return date and time.

  • Individuals: If the debtor is not present on the scheduled date but residency is confirmed, the Demand can be posted through the letterbox.

  • Companies: The Demand should be left with the most senior person present, such as a Director. If the premises are closed, it can be attached to the front door in a clear plastic wallet or posted through the letterbox.

Bankruptcy Petition

This is the second stage of bankruptcy. This document is issued by the Court and includes a scheduled hearing date.

  • Service Rules: These can only be personally served; however, a letter of appointment can be sent.

  • Restrictions: On the return visit, if the Debtor is unavailable, you are not permitted to post this through a letterbox as you would with a Statutory Demand.

  • Next Steps: If service fails, you must prepare an Affidavit or Statement in Support of an Application for Substituted Service. This is submitted to the court to gain authority to leave the document at the address, provided there is sufficient evidence the Debtor is living there and avoiding service.

Claim Forms

This type of document can be served in a variety of ways. They are issued by the Court and can be served by:

  • Leaving them at the address.

  • Handing them to another named individual at the address.

  • Personal service to the Defendant.

  • Service at the Defendant's place of work.

  • Leaving them at the last known address.

Divorce Documentation

These legal documents typically originate from a solicitor and require personal service on the Respondent. We also frequently act on behalf of private individuals to serve Petitions.

If personal service proves impossible, we prepare an Affidavit or Statement of Attempted Service for the court's review. Upon providing sufficient evidence that the subject still resides at the address, the court may grant authority for the documents to be served via the letterbox.

N39 Orders

An N39 Order must be personally served. This document relates to debt recovery, where the court mandates the debtor’s attendance for questioning.

  • Part One: The initial order to attend.

  • Part Two (Committal Order): If the debtor fails to attend the first hearing, this order informs them of a pending prison sentence for a specified number of days due to non-compliance.

Winding up Petitions

These are formal orders to dissolve a company. Service is executed at the company’s Registered Office, usually by handing the papers to a person in authority.

Note: Since Registered Offices are often the premises of accountants or solicitors, we ensure the document is left with a named individual who confirms they have the authority to accept the Petition on the client's behalf.

Traveller Proceedings

These proceedings involve the unauthorized occupation of land owned by individuals or corporate entities. Our role often involves:

  • Attending the local court to have documents issued with a hearing date.

  • Attending the site to serve papers directly to individuals.

  • Affixing notices to caravans, vehicles, and perimeter stakes to ensure legal visibility.

Service Injunctions

These relate primarily to mandatory annual safety checks for gas boilers in housing associations or rental properties. If a tenant denies a service engineer access, an injunction is issued by the court and served upon the tenant.

  • Residence Verification: This process often identifies "absent tenants" who have vacated the property without notifying the landlord.

Licensing Notices

Before a license is granted for a public house, nightclub, or similar venue, these notices must be displayed prominently outside the premises.

  • Purpose: To inform local residents of the application and the procedure for lodging objections.

  • Maintenance: We check these notices daily for 14 days, replacing them immediately if they are removed or defaced.

Injunctions

Injunctions require personal service on the Respondent and cover a wide range of issues, including anti-social behavior and family or child-related matters. We provide comprehensive coverage across the UK, including:
